Stamp Duty rebate on uninhabitable property?
Hi, I am a long-term property investor, buying properties often at auction, refurbishing, renting and holding. I am a RICS surveyor and CIOB Construction Manager so I have some good general knowledge.
I have recently bought a property which had been empty for about three years and had an EPC rating of F, no kitchen, no heating and unsafe electrics so the property required a new central heating system a full rewire and general overall refurb.
I paid £280,500 plus SDLT of £9940.
I contacted a couple of companies regarding reclaiming stamp duty based on the property being uninhabitable. One company said no chance unless it was structurally unsound.
Another offered to reclaim £6415 plus interest and I went with them only for them to go out of business!
I have full documentation including an initial condition report including descriptions and photographs, plus invoices for all work carried out.
Has anyone successfully completed a claim for SDLT rebate for a property in this condition?
I have checked the HMRC website, but as would be expected there is not much useful information.

Don’t know what solicitor you are using I purchased a dive end of April 24 never been touched for 30 years x council needed every thing sent pics to my legal team HE SAID NO SDLT completed with know stamp ! Sold the same in auction last week after clearance. So these solicitors are not doing their job right,my brief did run it past his partners for 2nd opinion both agreed after seeing pics and video of said property

I didn’t use a solicitor – I use a number of different solicitors but none felt they had the required knowledge so I used as specialist stamp duty rebate firm. BW BobG

Based on your property purchase price, you’ll get refund of £6415 plus a small amount of interest paid on top of that. AR claims will only charge you their fee once the refund has been successfully paid into your bank account – it’s a no win no fee business model. The whole process takes anywhere from 4-6 weeks roughly.
Highly recommend AR Claims.

I don’t know about experienced, 2024 new rules regs are overtaking me. I know me Housing Benefit -Just.
I only know these are recommended accountants from Stamp Duty point of view as done me two when my own solicitor said No No, house had been empty 15 years, water through ceilings, no gas or electric meters, worst house to live in I’ve had in 27 years & solicitor mentioned some caselaw & enclosed Stamp Duty specialists mentioned some more caselaw etc.
