Renting out a garage – agreement template?

Dear Readers

I have a 3 bedroom house that is let as a HMO. It has a detached garage which is not being used and I wish to rent out the garage separately.

This is my only property with a garage and I’ve never let a garage before. Does anyone have a template letting agreement for a garage that they would be happy to share with me?

I am wondering if a license rather than a tenancy wold be preferable. It would be easier to end it and gives the tenant less rights. Any of the legal websites where you can download agreements for a modest fee would have one. Net Lawman for instance has a license for a garage under their Lodger Agreements & license section for £11. They do insist however that it depends on how the tenant intends to use the garage. If in connection with a business it suggests a business lease is required. in this case I am guessing you would want the tenant to 'opt out' by signing an agreement to exclude security of tenure (also downloadable). Under the 1954 Landlord & Tenant Act commercial tenants have the automatic right to renew at the end of their tenancy which the agreement would do away with. By the way, if you have a mortgage on the property you might want to check to see if you are limited to issuing AST's only.

Hi Mike, thank you for your suggestion. I have now managed to find a suitable document online and have now downloaded a free "garage rental agreement" so I plan to use this.

no the garage rental did not go very well, the renter stopped paying the rent after about 5 months so I had to recover the garage, but at least there was no silly Protection from Eviction Act requirements so this was very straightforward. I've just used the garage for storage since then, rather than re-letting it.

It is a while ago now, but if I remember correctly, I think I may have got the template from the "Landlord Law" website. I did did a Google search and looked at the various results that came up and this one appeared to be the most suitable (many others were American, and were not suitable).
