How can I remove so called tenants?
I let a flat to a student, she has boyfriend with her. She signed the contract but the boy friend paid the rent I think.
They renewed the contract ( signed a paper for another year conditioned to old contract ) in august14 ( she was still in UK). In October we received complaints from the management company about their behavior and the police presented once… So we went and just feel weird as the girl is not there ( went back to her own country) and it seems the boyfriend has got other people living there.
We asked them to leave by email, They agreed to leave by 3rd Jan15, but I have now got an email from her ( not sure it’s from her ) saying they need to stay until 7th Feb15 ( I have a feeling they are not going to leave ) and use the protected deposit to pay the rent.
I am not sure how I can get them out , section 21/section 8 or just move his things out on 3rd Jan15 as he is not the contract tenant and she is disappeared.
I have previously called Landlord Action as recommended by Property118 and was advised to wait to action in June 2015 as the paper signed in August is treated as a new contract.
I would like to hear others experience on this as I am sure there is something I can do before that if no rent is paid or simply he is not my tenant.

First of all I would make sure that Landlord Action have all the relevant and latest information as I very much trust their judgement on these types of issues.

3rd Jan to 7th Feb is not long to wait if you get paid with deposit.

surely without your express permission the tenant cannot assign or sublet. for future reference if you had allowed the tenancy to rollover you would not have to wait so long.

I wouldn’t believe anything the (non-) tenant says about leaving in February. When tenants stall us in this way about rent payments it is nearly always a delaying tactic to stay longer rent-free. So whatever action you decide to take I wouldn’t delay.
