Flying freehold – advice requested
I am looking at (cash sale at auction) a terraced property converted into flats with a ‘flying freehold’. ![]()
The first and second floor bathroom overhangs on next door. Owned by housing association and which they converted with a shared garden (no division wall in the rear garden between the two properties). They are selling one of the properties.
My question is…where do I stand legally re any problems with maintenance with the next-door owner etc.
Can you get a mortgage?
Should I have my solicitor draw up an insurance agreement?
I would be grateful for any guidance before I sign on the dotted line.

Unless you get a solution from a specialist solicitor this will cause you problems in terms of mortgaging and re-selling.
