Hello, S21 has been issued and now in accelerated stage. Awaiting a date from judge. Council has just contacted me about tenant asking the following…

When did tenant move into the above address?
How much is the rent at the above address?
Why has tenant been served with notice to leave his/her accommodation?
Did tenant accrue arrears at the above address? If yes, when did the arrears begin to accrue and what are the current outstanding arrears?
If applicable, please provide details of any payment arrangements entered into with tenant to clear the arrears and the outcome of these arrangements.
Have there been any other management issues relating to tenant tenancy at the above address? If yes, please provide further information.
Can anything be done at this stage that would prevent you from pursuing their eviction from the above address? If yes, please provide further information.
Is there any other information that you consider may be relevant to my enquiries?

I could just say S21 and that a reason does not have to be given as it is not a mandatory requirement. Does that mean they have to assume it’s not her ‘fault’ and maybe help her to leave earlier so I don’t have to get the bailiffs in?
Do I just lie and say it’s because I am looking to sell? Do I just ignore the email completely?

Thanks,

Mark

And thereby hangs a warning. The council only have their own interests at heart. If they can tick all the boxes without moving from their desk, that's fine by them. They want the PLL to do their job for them.
No one cares about the landlord, remember that!

I had a tenant who payed some of the rent, and the council paid the rest "low income support" I think it was. All was fine until one day, the council told me I owed THEM £2800. They had reassessed (reduced) his benefit but did not get around to letting me know, or indeed changing the amount they sent me for another 18 months! Councils are USELESS, always steer clear of dealing with them.

The request for information is regarding the tenants homeless case, most likely they are investigating the tenants circumstances did the tenant make themselves intentionally homeless, checking for arrears, asb etc to ascetain if main duty is to be accepted or rejected ... nothing to worry about.

Most council will not accept a tenant is homeless until bailiffs remove the tenant.

ahhh but if i replied because of proeprty damage etc then this would I suppose be regarded as intentionally homeless. They would cancel their duty of care and tell them to wait for bailiffs making the possession longer.
The hope is that they still have a duty of care and move them before the bailffs if I say nothing .
I suppose though there is nowhere to put them anyway even if they still have a duty so they wont be in any rush to put them into expensive hotel accommodation. Looks like it will go to bailff no matter what.
