CCJs registered at property from ex wife?

I’m hoping that you can all help me or at least send me in the right direction. My partner and his ex wife are still on their Mortgage together.ccj

I am looking to buy the property or have her name removed from the mortgage and myself go on it. We have put money in to the house as it was left in quite a state.

We have found out that she has two CCJs in her name, but letters are coming to the address as she moved over seas and has not forwarded her new address on.

What should I do? Will the CCJs go against the property?

I hope anyone can answer my question or guide me.

    Hi Anna,

    A CCJ is registered against the person who owns the debt not against everyone who lives in the address the debt was recorded being taken at.

    If the debt is just in the ex wife’s name you should be ok, but check as often these things turn out to be joint debt after a split that was never sorted out properly.

    Hi Anna

    If your partner is not named on the CCJ he should also contact the relevant credit reference agencies and complete a ‘Notice of Disassociation’. The credit reference agencies will then seperate your partners credit record from that of his ex. This should go a considerable way towards ensuring your partners credit record is untainted.
