Court of Protection tenant has caused extensive damage
One of our thankfully soon to be former tenant is a “protected person” under the OPG (Office of the Public Guardian) and is in receipt of substantial medical negligence claim income under the supervision of a solicitor.![]()
Unfortunately the tenant has both allowed and caused substantial damage by both carelessness and deliberate act from broken furniture to totally inappropriate and unauthorized redecoration.
It is a requirement of the appointed solicitor to assume mental competence even to the extent of allowing the Protected Person to make inappropriate actions. The initial offer from the solicitor was derisory and the final claim is likely to be around seven times the deposit.
Does anyone have experience of or advice related to this circumstance?
