Hi, I’m seeking some advice. I have a tenant in my property in Wales, who is a month in arrears, (she has been in there for 18 months). The tenant said they had a medical emergency and had to go private, they stated in the email that bill was paid.
This is the second time they have used a medical emergency to avoid paying, although they paid the arrears over two months that time.
They proposed a payment plan over 8 months to pay the arrears, which was £500 in the month that the arrears were due followed by additional monthly payments over 7 months.
Obviously being a landlord with no choice, I accepted this arrangement. She hasn’t paid any of the arrears one month on!
There is a guarantor who has been informed of the arrears, but my agent isn’t keen to pursue the arrears with them.
What recourse do I have?

Write to your tenant saying that you had an agreement which they are now in breach of. contract. If this is part of your payment schedule with your agent, they should be doing this if not it’s down to you.
I’m not sure what Welsh legislation states but in the UK you can charge 8% on debt same as HMRC would charge you. Unless of course your AST states differently or Welsh legislation dictates otherwise.
I would question if you’re paying agents and they’re not taking action why are you paying them? Maybe a tack would be to say to the agent that you are happy to continue paying them once that they continue getting your rent which is what you’re paying them to do for you and do you want a credit on your account for all months that you haven’t received for rent?

What reason did your agent give to justify not acting in your best interests for which you are paying them.
And have they provided the options under the Rent Act to pursue rental non payment?
I would be checking up with their industry body whether they are competent and they are keeping the tenants deposit in accordance with the law.

If this is the second time your tenant has had a “medical emergency”, I would be asking them to clarify exactly what the emergency was and why they had to pay and proof (screen shot of their bank statement) that they have had to pay for private care)……all prescriptions are free in Wales!
