Help with selective licensing form?
Hello, I was trying to fill in the selective licensing form online, and I came across an abbreviation which I didn’t know, so I thought, go on to the next page, in case there are any more, and look them all up at once, but the online form would not let you go on to next page, without filling the form on that page first.
I then got in touch with the letting agent, who told me what it was, and I proceeded but again got confused. (here, I would like to say, that I am not well up on abbreviations etc, as the letting agent does it all). I then telephoned the council who said they could help fill it in, so an appointment was made. The lady at the council office asked me the questions and filled in the form.
After this, I then received an email from the council:
The first email from the council: “The freeholder’s name (I didn’t know it, as it is an agency that sends the bill), is ************ and the address is ****** **** we have sent the form to you, please fill in these details and send it back”
Well, I am totally baffled, if they had the name, address and the form, why didn’t they fill it in, as they were the ones that found it and filled the form in originally?
My letting agent was good and said I could send it over to them, (as not being computer literate,) but I couldn’t get into it. I have now found out the letting agent does not want to be the licence holder (as this was suggested by the council), as they would have to pay if there was a breach.
My biggest hate about all this is I do not see why a landlord has to have a DBS for something they own, and have to pay for it.
I went to the Council for help, as they were the experienced ones to fill in this form, and I am now finding that I am more stressed than ever. I also had to pay for someone to hold my office open and travel 20 miles to get there just to fill in the form.
Does anyone know anyone I can speak to for advice? Sorry everyone, just feel down, after all the emails back and forth, and threats from the council saying they were going to delete the application because it had gone on so long approximately for one week. Also, I have seen a draft report to the council, with a recommendation to remove my road, (my property is 16 years old), but the council have just carried on. Perhaps I just need a bit of TLC.

Your letting agent is not responsible for dealing with Selective Licences and, as with everything in the private rental sector (PRS) the buck stops with the landlord, as do most fines! You are the Landlord and you require a Selective License to rent out your property. Your agent who manages the property for you is your employee or “servant” old legalese.
Likewise it is for you to complete the form not a Council employee.
When you bought the leasehold property the Property Information form, completed by the seller, will have stated who the Freeholder is. It may be different from that which is on the actual Original Lease.
I’ve not come across a Selective Licensing scheme that requires the landlord to have a DBS ( Disclosure and Barring Service) certificate.
Have you as a landlord also registered with the ICO ( the Information Commissioner’s Office )? All landlords are required to as a landlord if keeping any information about your tenant (s)? Depending on how you keep the information you may be required to pay a fee

Many thanks for your comments. When I bought the property from new, 16 years ago, it went straight to a letting agent, and from there, I have just paid when requested, for anything they have done i.e.gas cert., smoke alarms, so until now, I hadn’t realised that there were other things required. I just thought the agent had everything in hand, or, would have told me what was wanted. My mistake for being naive.

I would suggest you join the NRLA and use their helpline. You should also know that all licensing is not just about the property, but about the landlord too, so they are checking that you know the names of the freeholder etc. I couldn’t complete the form on mine until I had notified the freeholder and managing agent about the licence.

Hi David,
Thank you for your advice regarding NRLA I will do as you say. I will also contact the freeholder, which is something I wouldn’t have done! Any helpful advice is much appreciated. I would have thought though, that the letting agent would have known for me to do this…but…now you have told me, it is a step forward…thank you. M.

They don’t do, so don’t try and sell you, courses at stupid money.

It’s not difficult to achieve a Selective licence, just a palava. The Councils are principally interested in the money so they don’t make it too hard.
