AST renewal post agent?
I thought this was going to be a simple, but there is so much conflicting information on the web. My property is currently let on a 12 month AST that was set up via an agent.
The agent has been useless and I am in constant discussion with them about other issues so I am wanting to move away from them anyway. The tenancy ends in December, but the tenant wants another 12 month agreement.
Nothing has changed at all. Can I do this myself by getting them to sign another agreement or does the deposit have to be returned (as the agent dealt with this) and start a whole new tenancy process prescribed information etc.

If you terminate the agency then the deposit will need to be repaid and then paid back to you to register with a deposit protection scheme. Ideally get this agreed in writing with the tenant before you sign the new tenancy.
You need to watch out that the agents don’t try to claim a renewal fee if you re-let to the same tenant – see e.g. https://www.property118.com/renewal-fees-tenants/

Good Morning Cheryl,
I would have a look at your landlord terms and conditions which i would imagine your agent got you to sign when agreeing to take on your property to let.
I am sure you can leave the agency, however there may be costs involved for early termination while there is a tenant in situe which your agency have found, which i would epect to see in your terms and conditions.
For exampole if your agency is managing your property for a monthly fee (
The agreement wouldn’t end in December and if it was not renewed it would roll onto a pediodic tenancy (Rolling contract of excisting terms).
