What are my options after a breach of tenancy agreement?

Hi, our local estate agent found us a company tenant who moved into our six-bedroom property on the 28th February 2025.

However, the company failed to pay the rent on the 28th of March. Part of the rent was three weeks late, and a further two instalments a week later.

The tenancy agreement has six entries as to who would be staying at the property. We have now found out that children are living in the property.

We also suspect that the named owner of the company could be carrying out rent-to-rent. All the above are not in the tenancy agreement.
We have served the tenant notice to vacate.

What else can I do in this situation?

Surely the estate agent did a credit check on the company?

If not, or if they did and there were warning signs, it sounds as though you should take legal action against the estate agent.

Didn’t think an AST can be formed with an LTD as it’s for individuals only. Therefore whatever agreement you have is not part of the housing act.

Did alarm bells not ring when your agent suggested this?

Sounds like potential for a big mess so you might need specific advice here if you have six people living and paying rent to the LTD.

Helen, you have lots of red flags here. You'll need to spend some money on professional advice - sound out some eviction specialists before approaching lawyers whose remedy can often be drawn out and expensive.
I would revert back to the agent as well and reject any pushback that they satisfied the tenant find requirement; threaten to formally complain to their trade bodies if they don't assist in hounding the LTD company tenant.

Should not have had a Tenancy Agreement but a contract.

If you have a decent agent then they should be giving you appropriate professional advice, but given the questions you are asking I fear they are about to wash their hands of the case, unfortunately.

Move on to get some expert advice.
