The Mortgage Works and Templeton LPA Receivers – does anyone have experience?
Hello everyone, We are having problems dealing with Templeton LPA Receivers who have been appointed by The Mortgage Works.
We are in dispute with TMW over any alleged arrears and The Financial Ombudsman has found that TMW have not been helpful in resolving the issue. We still await the payment that the Ombudsman instructed TMW to pay.
In addition, we believe that the appointment of Templeton has not been executed in accordance with the law and is invalid. TMW has singularly failed to answer our questions.
Their Legal Dept even claims they don’t understand the question. TMW refer to their instruction as a Deed and as such this should be signed by an authorised person with the delegated Power of Attorney and witnessed. Not signed by an Admin officer.
Does anyone have any experience or knowledge of this?
Many thanks in advance.
Amanda

I believe the Deed of Appointment of the lpa in our case has not been legally enacted. I have been trying for a year to get TMW to confirm their instruction of the lpa (Templeton) was legally valid. TMW have singularly failed to provide confirmation of this nor provide the information I have been requesting. Their legal dept even claiming they don’t understand my request! Which I have repeatedly made crystal clear. Their silence and continual reticence to engage speaks volumes

In my experience Templeton are not professional in the least. Have you asked them to provide a copy of your original Mortgage Terms and Conditions? Have they provided you with copies if their appointment? There are a number of other procedures they should follow but I don’t want to complicate the matter for you!
