When a Tenant Turned the Garden into a Rubbish Tip

Landlords expect to see gardens a little overgrown between tenancies. What one landlord found, however, was more like a fly-tipping site than a backyard. Household waste, broken furniture and even bags of rotting food were piled against the fence, creating a health hazard and attracting vermin.

The discovery

The tenant had kept the inside of the property in fair order. It was only at checkout, when the back door opened, that the scale of the problem became clear. Black bags split and spilling, mattresses left to soak up the rain, and a chest freezer dumped and rusting. Neighbours later confirmed that the dumping had been gradual over many months.

The consequences

Clearance required a licensed waste contractor, who removed more than two tonnes of rubbish. Costs ran into four figures, and the landlord faced delays in re-letting. Environmental health officers warned that the issue could have resulted in formal enforcement if left unchecked.

Best-practice lessons

  • Check external areas. Mid-term inspections should cover gardens, sheds and outbuildings, not just the interior.
  • Set expectations early. Tenancy agreements can require gardens to be kept free of waste and in reasonable condition.
  • Use local contractors quickly. Swift removal limits vermin, complaints and potential council enforcement action.
  • Keep evidence. Photos and invoices support any claim against deposits or guarantors.
