Hello, I’ve been a property investor for a while now with tiny portfolio. When George Obsorne introduced section 24 removing mortgage cost relief, we thought we would have to sell. So many friends stuck their heads in the sand. It must’ve been fate (and amazing luck!) to find Property 118. Swati and Chris. We don’t have a big portfolio but we did have enough to incorporate. They really know their stuff and wrote a detailed report for us. Then they made the incorporation process super simple guiding us through it step by step. Mark Smith from Cotswold Barristers is also brilliant. Our tax bill is now negligible - 2 years of tax in the Ltd company. When bonkers Liz Truss crashed the economy this week, I was in the middle of a remortgage. The product was withdrawn and I contacted Swati. I’m a professional London based Landlord / Developer in both the residential and commercial sector. I’ve been in the property business since I purchased my first investment property in 1995 at a young age of 19 years old.

I have a general understanding of property tax as property investment and property taxation goes hand in hand. Incorporation has been at the back of my mind for some time and even more so since the S24 restrictions on finance costs.

While educating myself on this subject, by doing online reading and speaking to accountants about incorporating of my residential portfolio, I thought there is much to consider i.e., remortaging fees, stamp duty and capital gains tax when transferring / selling the property business to my company. To be honest I was going round in circles as the more people I spoke to about this subject the more I was getting confused about what’s actually possible. I knew special taxation rules can apply if you’re running a property business and certain partnerships which mean that the stamp duty and CGT could be mitigated all together, but I needed assurance not from an accountant but from a professional tax consultant and a tax lawyer who understands what is achievable in taxation law to keep me on the right side of the HMRC.

Luckily, I came across Property 118 / Cotswold Barristers while doing a google search and immediately download their eBook. I read it a couple of times to digest and wow I was getting light-bulb moments as I thought this stuff relates to my situation and also confirmed some of my thoughts about what is actually possible. Also the eBook makes reference to HMRC manuals!

While growing up my Dad used to say “you need to listen to others but verify with evidence what they say”. I found what I was looking for, a professional Tax Consultant (Property 118) and a Tax Barrister (Cotswold Barristers) under one roof. Without hesitation I booked a consultation, we had a zoom meeting with Alex Norian and my trusted accountant also joined in.

We went through a lot on our first zoom meeting and Alex who is very knowledgeable. He explained very clearly an excellent solution to my situation. As promised, a couple of days later Alex sent me and my accountant a full report with a video recording of his recommendations. I then got confirmation from Cotswold Barristers that they agreed with Alex’s recommendation and would guarantee that if challenged by HMRC or a mortgage lender they would defend any such challenge at no additional cost. Armed with this assurance I agreed to proceed and I’m very pleased that my incorporation has been completed together with other smart IHT solutions and bolted on wealth protection mechanisms to keep everything within the blood line!

My decision to engage Property 118 and Cotswold Barristers to deal with the incorporation has been one of the best decisions I’ve made for my property business. Alex is friendly, professional and switched on and ensured I always had full transparency during every step and effectively made the whole incorporation process much easier. He always makes sure everything has successfully been seen to its conclusion, and always go’s the extra mile.

We Incorporated in June of 2021 our portfolio of 12 properties and we have been completely satisfied with both the decision and the personal support that we've received from our main contact at Property 118 who is Swati Samant. She helped us understand the rationale at the outset readily answered questions and walked us through. What has been most impressive is Swati's ready responses to our ongoing queries, if she doesn't know the answer, she seeks further advice from Mark Smith or others. This means that we are learning as we go. I couldn't recommend Property 118's Smart Company Structure enough, it has helped us focus on long term tax planning as well as reduce our short term tax liability substantially. Thumbs up from us!
