A leading industry body is warning the Justice Secretary that the removal of Section 21 will cause harm to the legal system.

Propertymark has written to Alex Chalk about the level of widespread concern from landlords and letting agents about the capacity of the courts to handle possession cases.

The Renters Reform Bill plans to abolish Section 21 and extend the grounds for possession under Section 8 which will mean even more cases have to go through the courts.

Lack of justice for landlords and tenants

Nathan Emerson, chief executive officer at Propertymark, points out the concerns from landlords and letting agents about the waiting times they could face in court to gain back possession of the property.

He said: “Since the Bill was published in May 2023 landlords and letting agents have expressed fears that they could end up left in limbo, uncertain how long they will be expected to wait for a hearing and ultimately, possession of their property.

“Failure to fund the courts properly means a lack of justice for landlords and tenants.”

Removal of Section 21 takes place alongside essential court reform

The industry body says without improving capacity in the court system proceedings to gain back property will be lengthy and expensive.

Propertymark argues that reforms to the court system are needed to speed up the process.

Mr Emerson said: “While most tenancies are ended by the tenant, landlords need to be confident that a property can be recovered quickly if the tenant has caused damage, stopped paying the rent or if the landlord’s circumstances change.

He added: “By adequately resourcing and reforming the existing courts system this will speed up the system, increase expertise in the decision-making process and ensure greater consistency with reduced costs.

“To improve access to justice for both landlords, letting agents and tenants, it is imperative that the removal of Section 21 takes place alongside essential court reform.”

Yes the Government are clueless but I think Bristol Landlord is correct when he says that this is a grand plan by the government to facilitate the takeover of the PRS on behalf of the corporations and with little opposition they will achieve the desired result.

They are not bothered about tenants otherwise they would not continue to proceed along this path.

Hmm, let me see, so it’s a tough choice between Incompetence vs Corruption?
It’s both of course.
Corruption is at the core but incompetence is very much there.

Government interference in the PRS is completely deliberate. The only question being exactly why?

Two theories for the destruction of the PRS:
1. National scapegoating
2. The moneyed classes hatred of social mobility.
My theory for the Government’s deliberate destruction of independent landlords is for reasons of greed and corruption by Government ministers. They want to corporatise the PRS for personal gain.

The government minister who announced in April 2015 the demise of mortgage interest being tax deductible for private landlords, but not corporations, was George Osborne.
After George Osborne left Government employment one of his later roles was in an “advisory” role at BlackRock.

Gove is the TENTH housing minister since Greg Clark in 2015.
Clearly not a very popular position which I believe is due to all housing ministers since 2015 understanding it is not a very good post due the start of the War on Landlords kicking off in April 2015.
Most likely Gove took the job in October 2022, hired by Rishi Sunak, because he’d just got divorced and there was nothing else on offer after being sacked by Boris Johnson in July 2022, and he got to keep his 150k government salary.
Regarding his oversight of the destruction of the PRS in order to corporatise it, I would say it’s not Gove’s original plan but he is the frontman and doing the dirty work for the higher ups.
Corruption is behind all this but Gove is personally incompetent as well.

As I have previously said, the PRS is still needed (might not be alive and well though) all of these REITs and investment companies will not be able to provide 4,000,000 rented properties.

If you are in Bristol, Bristol Landlord, then you have another disadvantage - your going to end up as a 15 minute city with 20mph speed limits and queues of traffic whilst the cycle lanes remain underutilised
