Rental Deposit – Tenant Seeks Advice

I was renting a property as we were renovating our own property. We took very good care of the house and had it professionally cleaned before we handed it back to the estate agency, who was happy but requested that the external drains be cleaned and the grass cut. After that began a long set of emails with rubbish claims from the owner such as there are weeds in the garden, cracks in the outdoor tiles (which I had not noticed and are not in the inventory – it was winter so we never went out) and loads of other things such as saying there was a smell of cigarettes even although we do not smoke.

I have tried hard to get my deposit back and even offered to give £200 from it to avoid the hassle and time wasting but the landlord wants the lot.

The estate agency is doing nothing.

Should I go to the dispute resolution or court and how do either of them work and are they any good?

This is the mail I received as regards the deposit, is this what you mean by certificate cos I have not received anything else by email or mail when we began the rent:
Dear Doctor Abdel-Aziz,

Your agent / landlord has successfully submitted a deposit to The Deposit Protection Service (The DPS).

Your Repayment ID for this deposit is:xxxxx
You will need the Repayment ID at the end of the tenancy so we can release the deposit to you and your agent / landlord as appropriate. Please keep the Repayment ID confidential and ensure that this advice is retained for future reference.

I log into http://www.depositprotection.com/ to access my deposit and where the owner has refused my claim. According to that website there are 2 types; a custodial system and insured system. The landlord has used the custodial system

Dear Doctor Abdel-Aziz,

You recently started a repayment request online and we submitted the details of that repayment to the Agent/Landlord for review. Unfortunately your proposal has been rejected by the Agent/Landlord.
As a result of this rejection, either party can now go online and start the repayment again. At this stage, the party who started the repayment will be asked if they agree to use the Alternative Dispute Resolution (ADR) Service, if there is a dispute.

The easiest and quickest way to resolve this matter is to make direct contact with your Agent/Landlord and jointly agree the repayment of the deposit. As soon as we receive both parties' agreement we will make arrangements to repay the deposit within 10 calendar days.

Sorry for all the basic questions but I am at loss

Went to mydep[osits website Iis that the correct site to do it) to start a DRS claim and its asking me for the deposit protection certificate number

All I have is what I posted before!! No certificates

There are three deposit protection providers. These are TDS, DPS and MyDeposits. They are not interlinked, other than by legislation.

If your deposit is with DPS then that is where you should start your claim. If you unsure what you need to do then call them during normal business hours to ask them for advice.

Have logged an dispute resolution service request although it doesn't look that encouraging. he can refuse and then all I have is to go to court!!!

Someone mentioned about a certificate and the possibility that I may have a claim.
What is that about
