Rachel Reeves’ selective licensing row exposes growing regulatory burden on landlords

Chancellor Rachel Reeves’s selective licensing scandal is a “perfect example of the challenges landlords face”, claims a landlord group chairman.

Paul Cunningham, chairman of the Eastern Landlords Association, says penalties for non-compliance must be applied consistently across the board.

His comments come after Ms Reeves admitted she had breached housing law by renting out her family home without the required selective licence.

Chaotic and complex regulatory landscape that landlords must navigate daily

Mr Cunningham says the breach raises serious concerns about the fairness of the selective licensing system.

He said: “This case highlights the chaotic and complex regulatory landscape that landlords must navigate daily.

“If a senior policymaker, who actively campaigned for selective licensing in Leeds, is unable to comply with the very laws she promoted due to lack of knowledge, it raises serious concerns about the clarity and fairness of the system.”

He adds: “Penalties for non-compliance, which may include both civil and criminal consequences, must be applied consistently across the board. Alternatively, the enforcement framework must be reviewed to ensure it is proportionate and equitable for all landlords.”

Landlords bear sole responsibility for compliance with a wide range of legislation

The Eastern Landlords Association chair adds the common misconception that income from the private rented sector landlords is “unearned” is far different from the reality.

He said: “Landlords are required to navigate a complex regulatory environment, ensure compliance with numerous legal obligations, and manage the day-to-day issues that arise in property letting.

“This active involvement demonstrates that income derived from the private rented sector is far from passive or unearned, as it demands significant time, effort, and expertise from landlords.”

He adds: “Letting property is far from passive. Landlords bear sole responsibility for compliance with a wide range of legislation, from GDPR and licensing requirements, to Right to Rent checks and property management. The risks and obligations are significant, and they fall squarely on the landlord, not a letting agent.”

The association is calling for a more informed and balanced public discourse around landlord responsibilities and urges policymakers to engage meaningfully with the private rented sector to ensure legislation is both effective and practicable.

    I agree wholeheartedly with the final paragraph.
    As the law stands today, Reeves has committed a criminal offence and should be penalised accordingly.

    Reeves is nothing short of a criminal.

    She, and her husband is also named on the tenancy agreement as joint landlord, should be prosecuted for s95 Housing Act strict liability offences.

    She also kicked out of the government and suspended from Parliament as lied saying she didn’t know she needed a licence to rent out her house, 2 letting agents told her she would. Such lies are putting the House of Commons into disrepute and the government as laughing stock on the world political stage.

    Hopefully someone has written to her tenants to let them know the simple procedure for obtaining a rent repayment order.

    She’s nothing but a lying cheat who should be fined or get a criminal record. I hope this sets a precedent for the rest of us because if the ones making the law are the ones breaking it, why are they in power and being allowed to destroy our country? What an embarrassment this party is and what a let down to the people of this country. They are making it very clear to us that they hate us all (even though we are the ones paying their wages), hate the country and are trying to destroy it every way they can. They can stop squandering our money. I want them to stop their hate campaign and thrown out of government.
