Hello, tenants were due to vacate the property this weekend. However, the tenants have told the management agency that they have been advised by the local authority to stay put as they are a couple with a young child.
Where do I stand on this? Any advice would be greatly appreciated!

Council’s have always told tenants to stay put until they are under imminent threat of homelessness.
And Gove would have you believe we don’t need Sec 21!!!! Under the Renter’s Reform Bill you will serve a Sec 8 and the local Council will just tell the tenant to remain. You won’t be able to demand rent, and you have to pay ALL your legal expenses whilst the tenants are being promised free Legal Aid.

With interest rates this high it could take months and months to get money back. They should do it like US. When notice is served it goes on their credit file. No wonder landlords are selling up. Buy abroad much better.

The whole system looks after the tenant as this looks after the state.
it is only going to get worse as LL realise this and sell up
like i am. currently running the gaunlet of our great unjust justice system
the system looks after the system, not the plebs who fund it all

I was faced with a similar situation many years ago. Single mum plus two kids and sponger boyfriend moved in without telling me. Needless to say the rent was late every month accompanied by every excuse under the sun.
Tenant then informed me the local council had advised her to not pay rent if she couldn’t afford it and not to move out because they wouldn’t be able to house her.
I had to keep my cool and offer Donna a solution. I had to be nice to her and her sponger boyfriend and persuaded her to declare herself homeless. It worked, she handed me the keys – I immediately changed the locks and she was housed in a hotel.
I have never taken a HB tenant ever since then.
Local authorities and the charities tell tenants to wait and live rent-free until they are evicted. Yes it’s scandalous but only PRS landlords suffer so society is fine with that.

Did you not leave them a pack with all the information in at the house when your first let it out to them? So you look to see what date they moved in and goto Google search that date see what version is available at that time download it and add it to your paperwork.

Thank you for your reply. It is not as simple as that and it was 6 years ago. I live in Spain and I interviewed the tenant, took his refs etc and took his deposit which I lodged with the TDS. Then three things happened, I returned to Spain, I appointed an agent who organised cleaning & repairs, a proper contract etc, the tenant moved in a week or so later. I didn’t have this agent for long because they were rubbish. However, I did call their lettings dept’ yesterday, kind of anonymously, and was told that yes they always issue the tenant with this leaflet. But i have no record of this nor have I ever had a copy of their tenancy agreement.
