Labour abolishing Section 21 from day one?

“Abolish Section 21 from day one” I’m assuming Labour would use ‘COVID style special powers’ to do this, as primary legislation would take us into next year.

Question – would abolishing, include cases where the S21 legal process has already been started? I imagine some of these will have been running for over a year, where the Landlord could have spent a fortune in legal costs.

What about where a court has granted possession under the current S21 law, but bailiffs have not evicted – would those be overturned?

I was no fan of the Tory’s Renters Reform Bill, but at least it clarified various grounds for eviction BEFORE S21 was removed.

To simply remove S21 without any other changes will lead to a long period of uncertainty until Labour’s new Rental Act becomes law.

    It will require an Act of Parliament, so it can’t be done on day 1 – which, as you say, means that any change can’t come into effect until next year.

    Changes like this normally come with transitional provisions to cover cases like the one you describe, where proceedings have started, but not been completed.

    She’s promised to do it from day one, possibly using old covid legislation. During covid, section 21’s were pulled retrospectively. This would be appalling- I just hope it’s not possible. I’d really like to hear from any lawyers out there if it would be possible. It will severely affect my plans if I can’t get possession and sell a few

    I suspect the day 1 promise is just a sound bite that will be diluted to ‘we start work on S21 abolition on day 1’ ie resurrecting the former Renters Reform Bill that Labour supported
    I can’t see a Lord Chancellor of any political colour being very happy about rushed legislation that attempts to overturn existing court judgments
    No doubt the process of implementation will be left to the Judiciary to decided
    It’s coming whoever wins ; playing to Generation Rent is just too tempting for them all. But as with all legislation that is not properly thought through ‘be careful what you wish for!’
    A further diminution of rented housing supply with no real new provision on the horizon

    They could possibly cite a housing crisis there not wrong !! emergency!!
    It’s a bit like a drowning person cling on to the rescuer and both drowning,
    Each other so glad I am out .
    Lets face it any old tosh from the tenant and it gets adjourned a court and
    can go on for years . Have a friend its been 4 years no rent going through
    the courts tenant siting repairs not done.

    Personally I can’t see them using some kind of emergency powers for this, that would look like panic.
    I would expect them to bring this in as one of their first acts of parliament though. Reckon you’ve got a lot of time to move anyone on before this actually passes. I would also expect it to be a tweaked version of the tory renter reform act.

    I’m listening to an NRLA webinar and they’re saying it will take Red Angela a couple of months to abolish section 21. They haven’t said how she’d do it

    Parliament can do anything it wants, it can recall over summer. Not that I see it happening. No body knows what Keir stands for. The manifesto is only a document to get through the election. Keir can’t sack Angela, but what government responsibilities he gives to her is on his discretion. We all know a blanket ban will be confiscation and in breach of our human rights. Even the labour party know we can all pack up leaving them in crisis. So we have time yet

    Are we all naive sitting ducks thinking they need to give us notice? Couldn’t they just bring in an immediate eviction ban?

    If we can’t get possession and have to sell with tenants in situ, the price will drop.

    The old covid era ban on bailiff-enforced evictions came to an end on Monday 31st May 2021.There is no reason why Rayner could simply dust off the old legalistion and ram it through parliament again as they will have a huge majority.
