Joint tenancy – can either evicted tenant collect all items?

My evicted tenants were on a joint tenancy. Apparently, one tenant had moved out and the remaining tenant had to be evicted, leaving a house full of items and some unpacked. Recently, he had asked to collect, in particular, his child’s item (as he has received a Court order) Now the other tenant (the mother of the child) has asked the same from me.

Neither tenant is allowed in my property, and the mother does not want to meet with the father but wants to collect ‘her’ items and their child’s.

My question is, can either of the tenants collect all the items without the consent of the other tenant? Also, how can I cover myself so that I am not liable for any further issues?

    Do not let them into the property under any circumstances. Put their belongings outside for them to collect at the agreed time.

    @Martin – very tempted to leave all theit items outside. As the notice for my ex tenant to collect their items have passed. And they keep cancelling to collect (free storage!) It is getting more appealing to keep what can be sold to cover my losses but cannot.. It is very frustating as my solicitor did not make an application for this! I cannot even record their collection process as it may cause confrontatoin..

    Update. My ex Tenant had collected all their items, they had told me they will be suing me.

    if you did what the law says then you have nothing to fear. I doubt they will get L Aid anyway…it will probably come to nothing.

    I agree. My ex tenant knows the system too well and very creative.
