To issue or not to issue an AST
Can I please have your advice on a matter that a mate of mine has found herself in? She has a house that her partner has rented out, but has never issued an AST, the tenant has not paid a deposit, so nothing was protected.![]()
The rent is very low, and the property now needs major work. She would like to increase the rent and also do some maintenance work on it.
The question is should she now issue an AST to have something in writing? or just simply to ask for an increase in rent?

Hi Antony,
Technically this could be a verbal agreement, but it puts your friend in a very difficult position for increasing or even proving what the existing rent was and also for eviction.

when did tenancy start? any more details? house habitable? anything else?

If she is happy with the tenant, then get a written agreement signed by tenant; if she is not happy or tenant will not sign, then issue S21 notice.
