Is my tenant still protected by the ‘Protected Tenancy’?

Hello, I bought a property in 2003 which had tenants in situ with a protected tenancy. They had been moved in very recently by a property company which had bought their previous rented property.

A tenancy agreement was set up by the property company describing the tenancy of the new property as ‘Protected’, but with a term of 2 years.

On my purchase, a condition was to take on the terms of the protected tenancy, so I have religiously sought rent revisions only via the Valuation Office Agency.

Is the tenant still protected by the ‘Protected Tenancy’?

    A protected tenancy is usually one under the Rent Act 1977, which brings a raft of protection for the tenant in terms of rent, term and succession.

    If you have been using the Rent Officer/VOA to do revies then it sounds like you do have a protected tenancy. In which case you can’t end it.

    However, as always with these cases you should get some proper advice.

    I suggest you get help from a specialist housing lawyer as the term covering Rent Act tenancies is usually a Regulated Tenancy. A protect tenancy may only apply for a certain period.
