How to deal with AST and two thirds split of rent?

If the lease states a flat can only be rented out as a whole unit rather than by rooms, would the below pose an issue or how I could overcome.thirds

– Family of 4
– Each parent has their own child from a prior relationship
– One parent will pay 2/3 of the rent

Should the AST just be addressed to the main parent covering the bulk of the cost, in order to avoid any issues with the “renting as a whole unit vs by room”… Or do I name him as the lead tenant and this somehow keeps the leasehold in adherence?

Thanks for your thoughts, I clearly have no clue!

I use a separate Deed of Guarantee with it being witnessed by someone unconnected with the tenancy. They need a copy of the tenancy since they are are guaranteeing it. You need one copy of the tenancy for them, one for you and one for the tenants to sign.

Hi so the background to the CCJ was due to NHS treatment costs whilst the tenant did not have a permit (using the wording given as I don't truly understand the ins and outs of this). Assuming the CCJ was issued Q2 2014 and that there is a verbal agreement for the repayment to occur from Dec 2015

Does this sound normal that there would be no written agreement (I guess it could be due to this being a recent agreement).

She is covering the 1/3 of the rental cost so slightly less worried as the male has a good track record.

If i own the property jointly with my wife, do I need to include my wife in the AST or can i simply represent as "The Landlord"

Hi Ray, you would expect the agreement to be in writing of some sort even if just an exchange of emails.

Fine for you to just name yourself as landlord if you wish - your wife doesn't need to be named.

Phew I had just printed 5 copies 🙂

I have asked her how much the repayments will be in case that impacts the monthly rent affordability...

Hoping to get some closure by the end of this week, will post back when this gets settled...

Hi guys planning to meet the couple on Fri to sign the contract.

What is the order of doing things:

- 1 months rent in advance
- 1 months deposit
- inventory check
- handover keys

If I meet on Fri and everyone signs the contract, do they need to have transferred both the rent and deposit into my account before I sign on the dotted line?

Assuming they sign the contract fri and then say sat transfer funds...could we then give keys and do inventory check on Sunday?

No idea what the normal protocol is, grateful of guidance

Do NOT part with possession of the property until you have the rent AND deposit.

NO excuses. No cash = no keys. Make that plain before you even meet them.

We are letting this unfurnished so will print an inventory checklist, a dated newspaper in the photos kind of thing.

Ah ok so I should ask for the deposit and months rent in advance in cash rather than an account transfer on the day. Once funds are in mans, we sign the AST, complete inventory check and then hand over keys.

Should I send the contract in advance by email so they have a chance to peruse..I mean the advert more or less covers the details anyway...

That must have been at least a full page ad if it covered the AST.

Yes, send them a copy in advance so they can raise any queries before they sign.
