Evicted tenant’s aftermath!
Hi Everyone, After agreeing with my tenant to evict him using section 8 rent arrears (so he becomes ‘homeless’ and gets help from the council)
I have been left with most of his belongings to remove, damage to the house and clean up costs, which far exceed his deposit value.
I have issued a notice of abandonment for his belongings, but my question is, can I add these additional cleanup costs to his money order CCJ I received with the section 8, or should I claim through the small claims court for another CCJ against him?

Part11 Section 6.
(3)If any amount is payable in respect of the goods by the bailor to the bailee, and become due before giving of the notice, the said period shall be not less than three months.

That won’t apply because it will be an involuntary bailment, not a contractual one. The former tenant is the bailor, the former landlord is the (involuntary) bailee. Why would any sums in respect of the bailed goods be payable by the ex-tenant to the ex-landlord?

What good would it be serving to your own, probably by now, empty property? The court will simply say the papers had not been served knowing that the tenant had been evicted and now not officially at the said property.

The court rules are that documents be served at the last known address.

Hi,
I’m waiting for Bailiffs now to evict tenant first time in my life, so first question is – when they are granted will anybody help me to evict tenant? Are there any Bailiffs officers who come to evict tenant who doesn’t want to move out? Second question is around her stuff, which, I am sure she will leave to make my live even more difficult. When it happens, I assume I should take photos of her stuff and give her 14 days to collect it and if this won’t happen, advise that I will throw them away? If I send her such message & photos via Whattsapp and email – will this be sufficient or I shall do anything else? Many thanks for your comments & advice.

You mentioned that ‘the legal expenses and rent guarantee insurance are taking care of it’ – and I need to buy one insurance soon, so after nightmare eviction process I’m going through now, I want to protect myself whichever way possible, hence would be grateful for the name of your insurer. Are these two policies or one policy which covers legal expenses and rent guarantee? Thank you.

You may well do that but you cannot take it any further, I know because I have been in that position. I then had to pay a debt tracer to find the persons new address and then pay another £130 court fees to have the address amended and wait even more weeks for it to go through the court again with the correct address.

I had a nightmare tenant and a year long eviction which lost me a fortune.
So I now insure with Simply Business who do rent guarantee and legal costs , but you have to have contents or buildings insurance as well. I think they are very reasonable they pay rent as you go along.
A much bigger landlord than I am recommended them.

There is no need to follow up, you will not get any payment. The purpose of the CCJ is to warn other landlords and to inhibit further fraud.
