Evicted tenant’s aftermath!
Hi Everyone, After agreeing with my tenant to evict him using section 8 rent arrears (so he becomes ‘homeless’ and gets help from the council)
I have been left with most of his belongings to remove, damage to the house and clean up costs, which far exceed his deposit value.
I have issued a notice of abandonment for his belongings, but my question is, can I add these additional cleanup costs to his money order CCJ I received with the section 8, or should I claim through the small claims court for another CCJ against him?

No. You claimed “rent arrears”. You have a judgement debt for rent arrears (and costs). You can enforce the judgment debt in respect of those arrears and costs, plus the additional costs of enforcement. The other stuff is additional. If the deposit isn’t enough to cover the additional storage etc costs you’d need a separate CCt claim. Is it worth it?

At least you got Possesion – some are really struggling in courts and thus landlords moving away from domestic sector.
Bite the bullet I guess and if deposit than use that to get rid of rubbish and keep receipt etc
I’m unsure but keep photographs or make inventory and allow minimum 14 days making it clear you will dispose of same.
Email or WhatsApp them clearly and save the message or print it off and leave on file.
Else might come back and bite you later …

Similar situation I had and I abandoned it. My repairs was close to £10k, after section 8 & torts etc I was essentially told it would probably cost another £8-£10k to do all the legals prep court appearances etc. FYI we put in a claim and ex tenant rejected it all hence the higher costs to provide the required details/ arguments etc . And I was told with CCJ would get £5 per week probably payment awarded as they was now on benefits etc. then if they stopped paying I’d have to go back to court etc. suffice to say my disgust at legal system etc I abandoned it. It’s why last week I completed on a sale of rental and I’m currently just freshening up another which thankfully the tenant left in good order to put up for sale next week and rest I have going very soon. It’s not worth it anymore. Oh unless you have empty property do a basic furnishing and then do a deal with serco or mears or whoever who will take it off you for 3 yrs or more pay at least if not more market rate and do all repairs etc and then House migration folks in it.

Moneyclaimonline (MCOL) doesn’t cost a fortune and may or may not recover of any of the money owed.
Yes, it’s worth it.

Possibly. Depends on quantum, hassle factor and ex-tenant’s ability to pay.

I hear all these horror stories about evicting tenants an leaving the rental market. I have an eviction going on as we speak, the legal expenses and rent guarantee insurance are taking care of it. Have you ever considered that?

Sorry to be blunt Guys but there isn’t much you can do to reclaim costs. Thats just the hard reality of being a landlord.
Trying to reclaim costs from the ex-tenant isn’t going to work because obviously he has run out of money. I tried MCOL and yes it posted a CCJ on the person, but that didn’t get me my money.
So this is why a) you choose your tenants wisely and b) you keep cash reserves for exactly this kind of mishap.

Nevertheless, it is important to make the claim to stop further exploitation of landlords and inhibit the tenants future financial abilities.

I’m more interested in getting another CCJ against him than the money TBH! He thinks he is sitting pretty awaiting a free council house now, as I evicted him! He has to have some consequences for his actions. Noooo, I’m not bitter LOL

Wasting good money behind bad..,?
If on benefits then £5-10 per month
Will waste another £250-500 for MCOL
Yes they’ll get bad credit
But they don’t care as on benefits
Personally forget and move on….
