Refund of SDLT surcharge upon sale to Ltd company?

Refund of SDLT surcharge upon sale to Ltd company?

We moved from our main home in late 2019 to a new home, so we paid an additional 3% stamp duty for our new home, and we have rented out our previous home since then.

Recently we have sold our previous home to a Limited company (we are the directors of the company, but the house was sold at the market value and Ltd company paid 3% stamp duty as well) and we are thinking of applying for repayment of the higher rates of Stamp Duty Land Tax but looking at the form on gov.uk website they are asking for the first and last name of the main buyer for our previous home and there is no provision of mentioning Ltd company name/details.

Has anyone applied for a repayment of the higher rates of Stamp Duty Land Tax while selling the property to a Ltd company? If so, what should we mention in the form where they ask for the name of the buyers?

Any help will be highly appreciated.

Thank you,
MS

Hi MS,
I like to use the Flow chart above as it is so simple, but it is out of date as you have a maximum of 3 years to sell the previous main residence and claim the surcharge refund.
However, I have not personally completed the forms.

Thank you very much Neil.

With the reference to the flow chart and guidelines on the gov.uk website, I think my scenario fits in the eligibility criteria (although there is no specific mention of a Ltd company scenario anywhere) but repayment form on a gov website has very specific field "First name of the person who bought the property" and "Last name of the person who bought the property" and no option to specify Ltd company details so I'm clueless.

My limited co had to apply online for council tax refund after tenant moved in and the form required first name and last name. I put name of limited co in first name and in last name i put none. The refund has duly arrived.

Thank you very much Sam.

I was thinking the same name of the company in the first name field and "ltd" in the last name.

Leave the first name blank, or just put in a space and put the full limited company name, including Limited, in the last name.

Hello MS. I am in a similar situation. How did the SDLT refund application work out for yourself? What values did you use for each field in the application?

Regards,
SP

Hi Simon, I think first and last name were mandatory so I couldn't leave them empty but I put company name in first name box and "ltd" in last name and application was successful.

Regards,
MS
