6 months rent paid in advance refund
My father has paid 6 months rent in advance as he is retired, but is now in hospital and unlikely to return to his flat. ![]()
Can he get a partial refund?
Thanks

Dear Monica
It depends whether the six months rent in advance related to a minimum six months tenancy. If that was the basis of the payment then no refund would be due.
I recommend that you check the tenancy paperwork as there may be other conditions too such as a duty to report to the landlord if the property is being left vacant for two or more weeks.
I have experienced situations like this and wherever possible I have agreed a refund on the basis that I will re-let the property and the outgoing tenant will pay rent up to the day the new tenant moves in and will also cover my re-letting costs and sign a Tenancy Surrender Agreement.
If you are nice to your fathers landlord then he/she might agree to something along these lines.
All the best and please let us know how you get on.
I hope you father is feeling better soon.
