Scottish Greens propose tenants withhold rent until repairs are carried out

Ariane Burgess, a Scottish Green MSP, has introduced an amendment to the Housing (Scotland) Bill, empowering tenants to withhold rent if landlords fail to address property maintenance within 30 days of notification.

She says the measure aims to ensure private rented homes meet safe living standards.

The proposal targets urgent issues like damp, mould, faulty flooring and malfunctioning heating or hot water systems.

By allowing renters to pause rent payments, the amendment aims to pressure landlords to act swiftly and protect their tenants’ health and wellbeing.

‘Stand up to rogue landlords’

Ms Burgess said: “My proposals will make it easier for renters to stand up to rogue landlords and to get vital repairs done quickly.”

She highlights the current challenges tenants face, noting that pursuing tribunal action is often daunting and places undue burden on renters.

Supported by Living Rent, the amendment shifts the tribunal dynamic, she says.

Under the proposal, landlords acting negligently must demonstrate sufficient efforts to resolve issues before accessing withheld rent.

There are good landlords

Ms Burgess continued: “Renters should expect their homes to be maintained to the same standard as any other.

“But in some cases, there are landlords who simply feel it is okay to take rent and let their properties fester with damp, mould and serious problems that significantly impact health and wellbeing.”

While acknowledging there are responsible landlords who maintain their properties, the MSP emphasised the need to address those who neglect their duties.

Ms Burgess said: “For those who rent these properties, it can be a miserable experience.

“People in this situation need more support and the power to make sure major repairs happen.”

    Withholding rent, like encouraging works to strike only serves to encourage investors not to invest and take their money elsewhere where risks are lower. The Greens and labour are returning us all to the 1970’s a swing to the right is going to be inevitable as a result of this mindless fools policies.

    Who determines what is considered neglect?
    The courts? Great add another burden to the already overloaded court system?
    For example:
    A kitchen unit handle has fallen off and the tenant is withholding 3 months rent.
    The Landlord fixes it, the tenant who does not want to pay rent takes it off again.
    We then have to burden the court system with this which costs the tax payer money.
    This is moronic politics at its best.
    Instead of penalising all Landlords the same. Build more houses, attack bad landlords and get to the root of the issue.

    Bet they haven’t even considered tenants that would damage the property on purpose just so they don’t have to pay rent. 100% guarantee this has not crossed their mind.
