Is the court inventing requirements?

I started a Section 21 process last February and I recently asked my solicitor if he had got a possession order from the Court. This was his reply:

“Put simply, I think the court have made a right hash of this case in that they seem to have invented the requirement for us to serve the possession claim on the defendant ourselves (which is the reason for the outburst from the tenant and her sister earlier this week)”

Could this be the case? I have seen nothing to this effect from any of my landlord sites. Anybody else had the same experience?

    Will do as soon as recieve the defence as I don’t know what the defence is yet. Can’t think what it could be. It’s a pre 2015 tenancy

    Its important you comply with the protocol and service – submission requirements, not just handling the defence aspect.

    I know Chris. It’s just that I have already complied with protocols for previous review date but the bundle obviously didn’t include their defence as they served it so late. I’m guessing will have to serve it all for 3rd time

    @ Chris. On a separate note I have recommended you to a friend called Chris as he is is getting sued regarding licensing, tenancy and lodger issues after helping out a friend. He should have contacted you by now and I hope you can help as he is in big trouble. I admire you stance for landlord rights.
