Hi, our new freeholder has inherited permitted development rights to add two storeys of flats to our four storey block. Builders are refusing to supply their insurance but admits it ends this July.

Do we have a legal right to see it to see how protected we are? They want to take out bricks to test the strength of building. The lease says freeholders have right to do remedial works but is silent on investigatory works.

Leaseholders have written refusing to consent to bricks being removed etc and replaced for testing purposes.

Do we have the right to refuse?

    You have the right to see the builder’s insurance to ensure your protection during construction.

    Regarding investigatory works, since your lease is silent on this, you can refuse consent until it’s clarified legally.

    Seeking legal advice is advisable to protect your rights as a leaseholder.
