Solicitors failing to pass on Service Charges?
I purchase my property nearly a year ago now and my solicitor’s company is refusing to pass on the Service Charges which I had paid to them for the management company as part of the completion.
The sale required an indemnity policy (as the vendor had laid wooden floors in the property which breached the lease), my solicitor’s company is claiming they used the money for the indemnity.
I have an email from my solicitor (who now has left the company) to the vendor’s solicitor stating that the vendor needs to pay for the indemnity policy. On the completion statement it lists the Service Charges but not the indemnity policy, so I would like to know, can I take the solicitor’s company to the ombudsman, or is there a better way to approach this?
In addition to this, the property has two leases, an old one of 125 years, and a newer one of 999 years. As part of the sale, my solicitor was meant to close the 125 lease, but I’m still chasing this.
Can I pay another solicitor to do this for me or am I reliant on my solicitor’s company to do this? And is there any way to follow up on the progress of this with HM Land Registry?
Any advice would be much appreciated.
