An updated version of Form 6a has been released confirming that after the introduced Tenant Fees act a landlord cannot serve a Section 21 notice if they have taken a Prohibited Payment from a tenant and that payment has not been refunded in full.
The new Form 6a must be used from 1 June 2019: Click Here to download the new form.
Failure to use the most recent form 6a might result in a landlord’s claim to recover possession of a property being declined.
This revised form was only released on line one minute before the June 1st deadline and wa critisized by ARLA who said: “We continue to make the Ministry of Housing, Communities and Local Government aware that updates must be rolled out well in advance of legislative changes.”
