Don't worry - you still did the right thing IMHO. You can't create a partnership one day and then incorporate the next day. You would have to wait three years and who knows what the tax landscape will be like in three years time! This way you saved yourself 3% in SDLT by beating the 1 April deadline and so look on the bright side!... Read More

Evidence could include things such as receipts claimed or payments made by wife. If everything is done through a joint bank account it is obviously harder to prove that one partner isn't just passive, but if neither have another occupation it is equally harder to argue that only one of the owners is running the business . . . .... Simon. A partnership for these purposes is defined as "the relation which subsists between persons carrying on a business in common with a view of profit" (Partnership Act 1890). The simple joint ownership of property by two or more people whether or not they are husband and wife does not in itself create a partnership. However if you can evidence the fact that both are actively working on the business then a partnership may exist and if you take the step of obtaining a UTR for the partnership and filing partnership tax returns then there is even less chance that it could be challenged that partnership doesn't exist....
