Can I change the tenancy terms after finding out tenants are not students and paying Council Tax?

Thanks all, having read all of the comments I am a little confused to the say the least. The council (Charnwood Borough Council) are not being at all helpful and are simply stating that because the property is a HMO (3 or more unrelated individuals) and the council tax account is in my name not the tenants, I am liable for the council tax, end of story.

The 3 tenants are however under a single tenancy agreement so I am not sure if this actually means they are responsible for the council tax and this overrides any clause in the tenancy agreement which says otherwise. What do people suggest as a way of taking this further with the tenants. As far as they are concerned they believe the tenancy agreement means they are free from any council tax responsibility.

The tenants are all under one AST but speaking to the council they seem to still class this as a HMO as there are 3 non-related individuals living in it. There are no locks on bedroom doors and the tenancy agreement states one overall rental amount for the entire property. As far as the council are concerned, as it is a HMO the council tax responsibility lies with the landlord.

As for the student IDs and university information these were all filled out at the start of the tenancy period. It was not until 5 months into the agreement I was notified that not all of them were full time students.... Read More

Thanks for the comments everyone, as I expected there is not a lot I can do given the lack of specific reference to 'council tax/ student status changing' in the agreement.

It seems the only way I can cover any potential for council tax charges being owed in the future is to add a clause in the agreement where should the tenant's student status no longer stand, this will result in an increase in the rental amount owed?... Read More

Hi Mandy, unfortunately the tenancy agreement just states,

"The following outgoings on the property are the Landlord’s responsibility... Council tax".

The only mention of their student status is in the schedule where it asks for their university course and student id number.... Read More
