Cornwall searches for Landlords to help stop homelessness

DON’T TOUCH IT.
A few years ago I had about 85 properties on this scheme with the district council. It worked OK. Then Cornwall Council took over as the new unitary authority. It became a nightmare. We now have none. A developer I am friendly with had IRO 50 units on the scheme and like me was delighted to take the last one back in hand no long ago.
The admin is so bad that the chap we used to work with actually committed suicide in the summer due to the ridiculous demands being made by the bosses. Accountants not property management.... Read More

Gary and Jay, apologies for the delay responding, I have been in discussions with our legal team for clarification.
The basis of my suggestion comes from common law. In essence, there is no valid tenancy, i.e. a tenancy could not be created as one of the “owners” did not give permission. Without mortgagee's consent the tenancy is unauthorised. As an illegal tenancy, the landlord has no right to enforce the obligations of the tenancy agreement including payment of rent.
Compare with the HMO licence situation…if you don’t have a licence when required, the tenant can claim all the monies back under a rent repayment order (the legislation in the Housing Act 2004 allows for such).

I remember a discussion thread many moons ago when I consistently advised not to let without your lender's consent. Most of the other views suggested to the contrary. It was why I stayed away from this site for several months because the quality of discussion is poor and advice was incorrect. That, and the constant plugging of the 'stack em high, sell em cheap' online agency. Nobody asked why I said what I said. Now you know the reason why.
