Summerhouse, Annex, Studio? Could I rent to a lodger?

I built an annex for my mother to live in some years ago, it could be accessed through my conservatory or via it's own front door. All services are connected to my residence. The local Council came round to inspect it as they were keen to create an extra charge for Council tax as it was an independent living unit. On inspection I was told that because it could be accessed directly from my house it was classed as part of my house and they could not charge Council tax on it. I can only speak from my experience. I suspect that if you are going to call it a summer house that is exactly what it will be and you will be limiting it's future use and would not be able rent it out unless you applied for a change of use. If I were you I would be calling it an extension to your own residential property for extra living accommodation. That way it would be no different to renting out an ensuite bedroom in your home and would be able to claim 'rent a room' tax relief. Tenant asking not to extend S21?

In my experience any letter you write will make no difference to the Council. They will not take any steps to rehouse her until the bailiffs have evicted her. One of my tenants was in the same position and the Council advised her to stay put until I had a court possession order and had instructed bailiffs. They told her that if she complied with the S21 date she would have made herself intentionally homeless and they would not have to help her. Abandonment notice after doing a bunk?

If you do not have the keys back, my advice would be to continue with a court possession order. I took short statements from the neighbours of my tenant stating that they had seen her moving her furniture out. The judge awarded me possession on the day it went to court. Expensive and drawn out procedure but you will stay on the right side of the law.... Read More

Pros vs Cons of having UC tenants?

I have had 3 tenants on housing benefit which was paid directly to me, all were happy with this arrangement. When HB changed to UC and it was paid to them, all three kept it, and I did not get another penny in rent from any of them. The application process to apply for direct payment, due to their arrears, was so slow that I had evicted them before receiving any rent payments. Once they are no longer your tenant you cannot apply for arrears to be taken from their UC payments. I may have been unlucky but learnt a valuable lesson and would not entertain accepting another UC tenant.... Read More

Loft conversion without planning permission or building regs

I have been in a similar situation. My solicitor advised me to delay the purchase until the current owner had obtained retrospective planning permission, which is what I did. If the loft does not comply with building regs, then you are buying a 2 bedroom house not a 3 bedroom and the value should be adjusted accordingly.... Read More
