Problem with drunk and threatening tenant

Hey!

I've been here a good few times before.
If your personal 'judgement' of him is he is ok i.e. it's a one off; give written warning mentioning you will go for eviction if it happens again. Tell the threatened couple if it happens again to report to police and then you will evict him. It's getting to the point where I am quite tempted to wear one of those camera's on the body that police have to record and video all communications with 'tricky' tenants.
If he's unlikely to play ball then sometimes paying them to leave can work (yeah I know!; but sometimes it's the path of least resistance though expensive ).
I'm not sure how you credit/referenced checked your tenants. I always (from now!) get a professional one that is backed by a landlord rent guarantee insurance . So *in theory* I should never be out of pocket if things do go wrong.

At this point in time I have 2 disputes with the DPS, 1 CCJ in action and 2 high court writs on the go. HMO's require TONS more work in terms of social 'people' dealings!

What am I entitled to if tenant leaves after 1 month?

Hey

lol. I've been on this merry go round before!
I got the tenant (when he would communicate to me) to send an email stating he had left and keys were in the property; I did this deliberately to avoid obtaining a possession order - done 3 already this year!.
By pure chance I was visiting a solicitor today for a stat dec ; I asked about my current situation. The general response would be it depended on the judge's opinion on what was a 'loss' and whether the tenant should be bound financially to the 6 months i.e. owes all the rent.
From all the responses it seems clear there's no 'correct' answer.......... Read More

Too be honest my gut feeling that simply losing his deposit ( 1 months rent ) would be fair .
Still makes a mockery of a ' 6 month ' contract
For the record when tenants do want to leave early and approach me with a months notice I don't charge them a penny !... Read More

Wasn't proposing anything

I tried to help this guy and he just ups and leaves and has requested his full deposit from the DPS

I had tenants attack me , lie , run off , abusive, 100 bottles of urine in a room , dealing drugs etc .
They all have to leave somehow and at some point based on that behaviour. Been to court 3 times this year and on my fourth stat dec this year .
Perhaps I'm becoming cynical as I get older but I always try to be firm and fair .
Why should I suffer all the social issues when a person just can't be honest and fair ?

In my experience landlords deal with a lot not just the leaky washing machine and a bit of painting .

Whilst the government has it in for us they have no ideas of the real workload .... Read More

Thanks for the information.
I filled the room about 5 days after he left (he didn't give any notice). So I can only claim for the 5 days?
Whats then point of a timescale on the contract then?

If I take a 12 month contract out with Vodaphone and then after 1 month swap to orange I still owe vodaphone for 11 months.

Why is that case different?
