Landlords rejoice as Superstrike problems are no more!!

No doubt there will be a flood of new questions arising (although it would seem that things are slightly more streamlined now). Mine is this: The need to re-protect/re-issue PI at renewal or periodic has now been eliminated but if prescribed information was never provided in the original term, then presumably the pre-act situation remains in place, ie. a valid 21 can't be issued until PI issued and a claim for 1-3 times the deposit can be made?
And also if the deposit is protected well after the 30 day limit and no PI issued, again the same penalties apply with the added aspect that the deposit must be returned before being able to serve 21?

My tenant gave me just 8 days notice - help please

If I have understood this discussion so far, there seems to be a lack of certainty as to whether there are statutory laws that prevail regardless of what the Tenancy Agreement says?
Since I am experiencing similar uncertainty regarding tenant notice to quit (as a tenant), can someone clarify - assuming it is possible to do so.
I found this: "The Tenant’s notice must be for a minimum of one complete tenancy period, and must expire on the last day or the first day of a tenancy period.
Shorter notice may be accepted by the landlord, but there is no legal obligation on the landlord to accept a shorter notice than is required by law."
This aspect of tenant notice not only needing to be at least one month but also having to expire on the last day of the rental period does not seem to have covered in this present discussion. Tenant notice to quit - very confused, please help

Many thanks for your reply Mark. Yes, I am aware of the possibility of claiming for the deposit plus 1-3x deposit value. I am not ruling this out but ideally would like to wait either I have left or have confirmed a new property. This is is because I am living with a family member who is dealing with serious medical issues and for their sake I would rather avoid the stress of litigation while we actually in this property. I happen to be dealing in this instance with a very difficult and irrational landlord who knows nothing about the law, aided and abetted by their agent. It is the first time it has happened to me since so far I have always dealt with reasonable landlords.
When I would like to leave: possibly in the second half of March (rent is paid til 15 so I dont want to leave before). However I believe that in that case I I wouldn‘t be able to follow to the letter a notice that gives a minimum of 1 month notice ending on last day rental period (for example if I left on 25 March and gave notice on 25 February). I would in any case intend to pay rent for every day I am here.
I will think about your suggestion of leaving without giving enough notice and then if they tried to claim I could counterclaim for non compliance with deposit regulations. Thanks... Read More
