Peter, There are about 16 different ways they SDLT can be wrong and the major part is finding out which. Once you nod that the repayment process is simply to send a letter amending the Return. HMRC are a bit slow dealing with these (no surprise there!). But do get around to it.

The important thing is to get specialist advice on the error or, perhaps, get the advice before you complete and pay the right amount in the first place.

How do you split and avoid stamp duty and CGT?

Hi Glenn,

As they aren't married then HMRC will regard any changes in ownership as being taxable. So the removal of one party to the mortgage will trigger SDLT on half the mortgage. There will be CGT as well as the transfer is a disposal by one co owner.

If they are a partnership however the answer is different - No CGT and, provided he withdraws only his share of the capital, no SDLT either.... Read More

You need to look at something called Multiple Dwellings Relief. This would charge the SDLT on the average price paid. This should effectively make the SDLT charge the same as 2 X £750K houses and not one £1.5m one.... Read More

Additional stamp duty deadline for Land Registry?

I've read that article twice and can't see any reference to having to register wiht LR before 4th April --- Where is it?

I've spoken to a friend who has read up on the proposals and he assures me that only one tax charge can be made and that is at the date of completion, registration date isn't relevant.

It would seem that the journalist has things wrong.....

Solicitors who read the consultation will know that there are suggested changes to the SDLT Return that will allow this charge to be calculated. Whether HMRC can update the online Return service in less than 6 weeks remains to be seen!... Read More
