Golden Handcuffs?

I had the same problem with 2 properties,
I had a FAILING Mgt Agent numerous incidents all documented and most via emails.
I offered a termination fee.
They refused and relied on their contract.
I took it to the Property Ombudsman, as an UNFAIR CONTRACT CLAUSE and my offer of 3 months termination fee, with all my evidence of the agents failing including LYING to my tenants that they were awaiting my permission to do work when they had NOT even tried to get to me.

It took Months but the Ombudsman agreed with my Unfair contract clause and the agents failings. I had to pay a fee BuT KEPT my GOOD TENANTS.

NO, I only had the one AGENT, for over 10 years.
It was working OK until they tried to raise the Fees Percentage via a news letter, They reverted when I complained. Then they started failing in their Mgt role, Maintenance items were delayed, Safety issues went months without resolution, they lied multiple times to my tenant saying they were waiting for me to authorise a repair, when they had not even tried to contact me. I gave them notice, they replied on their clause which was found to be an UNFAIR clause by the Ombudsman.... Read More

How should we go about a change of letting agent?

I recently won a case against my Agent via the Property Ombudsman.

My agent had a clause in our contract which said I could only fire them when the tenants had left and were not returning for over a year.

I contended that was an UNFAIR contract clause and offered to pay a termination fee of 3 months. The agent disagreed and relied on his contract.

The Ombudsman agreed with me and awarded me a small compensation and an acceptable termination fee.... Read More

I thought I had a good chance of winning as I store ALL emails both ways, the Agent was unable to disprove the detail I had on all the incidents. Also the Contract Clause was OBVIOUSLY unbalanced giving me no termination possibility. I have also won a number of Small Claims Court cases again having lots of detail, the SMC is sometimes quicker and if you have an expert who knows his job . But the Ombudsman has more clout the agents are signed up and have to accept the decision.... Read More

Termination of contract fee is extortionate

I had a worse problem with my agent who for years was reasonable, but then the service dropped off and the agent LIED to my tenants saying the were waiting for my approval for a repair when they had not even contacted me. after complaining I decided to end the relationship, but their contract had a clause which said that I could NOT TERMINATE until the tenant had left the property for a year and not returning. I took this to the Property OMBUDSMAN who took some months to review my complaints, and I won the case and some compensation, but I have to pay a termination fee. which is worth it. There is a lot of Admin you need to set up and do, such as Deposits, bank standing orders and replacement contracts etc.... Read More
