Surely I am not the only landlord worried about new EPC requirements?

I am in exactly the same boat as you, with several Victorian/Edwardian houses in our portfolio which I suspect will be virtually impossible to bring up to category C. I have been worrying gently about this for a while now, to the extent that we are seriously thinking about selling all those houses where we think it will be extremely 'challenging' to meet the new requirement. Yes, I wondered about this, as a user of My Deposits. However, I checked one of the certificates I have sent out recently where one of our tenancies became periodic, and although My Deposits refer to 'statutory' when you renew the protection, the actual certificate simply shows Protection Type as 'Periodic tenancy' , which I thought was probably a good thing.
If I can summon the energy, as a tease, I might write to My Deposits and ask them what I am meant to do when a fixed term becomes Contractual Periodic. (I rang several local letting agents in my quest for more info on this matter, and they all sounded completely blank when I mentioned contractual!)... Read More

That is a bit sneaky! I have found this discussion thread extremely useful, and I will definitely be asking my regular agents to include a clause about continuing as Contractual Periodic in future (while checking for sneaky clauses re fees).

Ok, thanks. Although they told me they do the same as me at the start of statutory periodic, i.e. reissue Dep Protection Cert, they also said they send H2R and all the other bumph (EPC, EICR, etc) when they send out a Section 21, which I think is the point you are making. Interesting that there is no penalty for late issue of H2R! Where did you get this useful bit of info from?... Read More

I think the point was that if a letting agent uses an AST which defaults to statutory, this allows them to issue another fixed-term at the end of the initial one rather than let it rollover into periodic - and I presume they are allowed to pick up some sort of (small) fee for doing this. However, if contractual periodic is specified in the initial AST then this is no longer an option.
And on the council tax front: as I read it, contractual leaves the responsibility on the tenant in a way statutory does not, so contractual would BENEFIT the landlord (and this is the route I shall take in future).
