On a different note - and I'm going to display my ignorance here - can somebody explain to me about the appeal process, please? Is an appeal a rerun of the original trial with nothing added and nothing taken away or can new information, evidence, witness statements etc be submitted?

FOS rule West Brom Tracker Rate Hike is fair

The reports you may have read in the media about the FOS's decision imply that there has been one response to all. This isn't actually the case. Many of us who took our complaint to the FOS got a response along the lines of 'we're not getting involved in this' and 'let the court decide'. The FOS has proved to be completely toothless when it comes to this case. The responses I received made it clear they didn't even grasp the fact that I was complaining about a breach of contract. I think they thought it was just a case of sour grapes. I'm glad that everyone can now see that going to the FOS is a total waste of time and that the only way of defending yourself against this underhand financial institution is in the Commercial Court where the judge understands contracts. The Representative Action organised through this website is the only realistic option.

The West Brom have proved themselves to be happy to break a contract when they feel like it - so why would anyone believe that they would honour a promise to apply the Court's findings across the board - to members of the Representative Action and non-members alike? It's time to stop believing that there's some warm fuzzy independent institution out there who's there to protect you from these financial bullies. There is no such institution. That's why you should become part of the Representative Action where we'll get the justice for ourselves. United we stand.... Read More

Welcome on board Paul! I read your comment with interest and think it goes some way to explain why so many of the original members are yet to commit to the Mark Smith route so, thank you for that.

I was one of the few who were able to attend the Members' Meeting in London last month and I have to say it was great to finally meet other people in the same boat and to be able to speak openly about the situation. I think it's fair to say that none of us left the meeting with any doubt about which course of action to take. In the straw poll we took at the time, EVERYONE plumped for the Mark Smith, self-insure route having heard both options from the horse's mouth, so to speak. The people there represented 84 mortgages.

Now the Law Department have withdrawn and are refunding the remainder of the funds to all involved, I urge everyone to redirect that money to the BARCO account and finish the fight you've started. As far as all of us at the meeting were concerned - and I hope you'll all forgive me for speaking for you here - this was not the back-up plan, this was the best route for all concerned. So please don't feel like you're left with a choice of one.

I look forward with enthusiasm to hearing today's tally of mortgages! It really is quite addictive - every time my phone pings I race to the site and give a little whoop on seeing the total rise! We'll get there for sure but will you be one of them?
