Rent arrears - Benefit Nightmare?

Thank you everyone for your guidance. To update you. I sent him a text explaining that I would now be contacting the DWP directly to apply for them to pay the rent arrears that they had created because of the suspension. And lo and behold!! I receive a text message immediately saying that he'll be paying the rent arrears within the next week (he's currently paid 2/3 of it back). I've also spoken to the Housing Department and he has been made aware that he won't be eligible for housing if he doesn't pay off his rent debt because, as you say, he's made himself deliberately homeless.

I also pointed out that I am well within my legal rights, based on the original tenancy agreement, to claim back the full amount of rent which he hasn't paid for quite a long time now, which adds up to a significant amount.

Am getting there, but it's frustrating to have to play these games with tenants.

I decided quite a long time ago that my achilles heel as a landlord is always falling for a sob story and ending up with some pretty awful tenants as a consequence. So although I still manage my own properties I have handed over the responsibility for finding tenants to a letting agent. This chap is the last of a long line of bad tenant decisions. So nearly there!!

So glad you won! Well done. These tenants have re-written the whole story to make me look like ruthless landlord. None of what they are saying is true, they've picked out specific comments I made in text messages taken them out of context which make it look like I am admitting fault. And this is the basis on which they're making their claim.

There's no way I'm paying the suggested £7,600.00 amount to make this go away. I can't afford it for a start. If I have to spend time preparing for court then that's what I'll have to do. I'm a very organised person so I'll definitely make sure I have every angle covered before I get to court.

But they are currently being chased by a whole host of debt collection agencies and they already have CCJ's against their name so I'm assuming they think this might be a chance for them to make a bit of money out of me because I've always been a soft touch.

I've heard such conflicting stories. My accountant says 'The courts always find in favour of the tenants. They hate landlords' and then I've heard completely the opposite!!

But although I will give people a chance (this tenant had just come out of prison and said she said that nobody would give her a chance for a new life) I'm not going to roll over and allow myself to be abused in this way.

I've hardly slept a wink since the solicitor's letter arrived. But I will fight it, on principal, if nothing else.
