As I said above, if they don't reopen the complaints, which from what understand of the process they don't proceed with them if court action is ongoing but they will consider once the action is resolved, then the issue with the level of compensation is a separate complaint altogether which the FOS need to deal with independently.... And it appears the con doesn't end...

I've had my letter offering interest on the additional amount taken as 'compensation' but they should be offering this anyway for 'deprivation of funds' at the 8% simple interest statutory Court rate on the additional amounts taken for the number of days since the amount was taken from the account. This isn't really compensation, this is standard practice with both FOS and Court payments. So if they they think I'm taking this as compensation they are sadly mistaken. I'll also be looking for a distress and inconvenience payment to cover the letters I've sent them. I understand you can justify £10 per hour to a max of £100 per day (FOS technical notes). So I'm looking at at least £500 extra as well.

If this isn't paid I'll be putting in a separate complaint to the FOS about the fact that they aren't applying compensation in line with FOS guidelines, which should class as a separate complaint to the one I originally sent to FOS as they put this on hold due to the Court case. Let's see how they like an additional FOS fee if they don't pay out. Should only cost them another £3m so they may as well round it to £30m...
