Council tax per room for HMO in Nottingham!

We had the same issue about 10-12 years ago, and ended up in court! My comments are from experience and have no qualification.

As you have no kitchen facilities behind the bedroom door, I would not think the units can be classed as self contained as they do not provide the 'three basic amenities'. The three amenities being toilet, personal washing facilities and cooking facilities. The definitions are very long winded but if you google Section 254 Housing Act 2004 this covers the definitions the council will work to, although the VO may have there own version.... Read More

You are correct. I should qualifty my comment as suspect the wiring will fail, as it has not been upgraded for at least 28 years (during current tenant occupancy). I personally do not know of any issues, and the tenant has never reported any problems.... Read More

I would think it is a periodic tenancy after the AST expired. I thought an assured tenancy (sitting tenant?) was when the tenant was present before 1988.

Re: gas. We have always had the gas check done, and this year we actually had to have a new boiler fitted as they had no hot water. They will allow access for essential works. I am sure they would allow the EICR to be done, it is the fact I know it would fail and need a full re-wire.

I know there is subsidence in the property, and dry rot. So it is not really just about access for repairs. It needs gutting and full refurbishment.

I have offered an incentive of £1500 to move within 3 months, and I actually said they could stop paying the rent if that helped them to get a deposit for their next accomodation. The problem is they have been there so long at a low rent, any similar accomodation is more than twice as much.... Read More

Unlicensed HMO with 2 self contained Units and 2 Rooms

I am not qualified but I have had various discussions with my local authority regarding, what is, and what is not, a licenseable HMO. My understanding is as follows:

Empty rooms dont count, but obviuoulsy cant be used.

If there are any shared facilities, you have to count all rooms even if some are self contained.

If you have facilities not shared, but not behind the front door of the individual room, you still need a license if occupancy levels dictate.... Read More
