I would think it is a periodic tenancy after the AST expired. I thought an assured tenancy (sitting tenant?) was when the tenant was present before 1988.

Re: gas. We have always had the gas check done, and this year we actually had to have a new boiler fitted as they had no hot water. They will allow access for essential works. I am sure they would allow the EICR to be done, it is the fact I know it would fail and need a full re-wire.

I know there is subsidence in the property, and dry rot. So it is not really just about access for repairs. It needs gutting and full refurbishment.

I have offered an incentive of £1500 to move within 3 months, and I actually said they could stop paying the rent if that helped them to get a deposit for their next accomodation. The problem is they have been there so long at a low rent, any similar accomodation is more than twice as much.... Read More

Unlicensed HMO with 2 self contained Units and 2 Rooms

I am not qualified but I have had various discussions with my local authority regarding, what is, and what is not, a licenseable HMO. My understanding is as follows:

Empty rooms dont count, but obviuoulsy cant be used.

If there are any shared facilities, you have to count all rooms even if some are self contained.

If you have facilities not shared, but not behind the front door of the individual room, you still need a license if occupancy levels dictate.... Read More

Buying without planning permission or building certificate?

If the 'old garage' was already there, they cant make you take it down. You dont need planning permission to change internally, but should have had a BC notice for insulation/drainage.
If it was an old garage, the footings might not support a second storey extension, so you will need to knock it down anyway.
The conservatory may have been built with permitted development rights. And if thermally isolated from the house, (equivalent of insulated/back door between) does not need a BC certificate.... Read More
