Buying without planning permission or building certificate?

If the 'old garage' was already there, they cant make you take it down. You dont need planning permission to change internally, but should have had a BC notice for insulation/drainage.
If it was an old garage, the footings might not support a second storey extension, so you will need to knock it down anyway.
The conservatory may have been built with permitted development rights. And if thermally isolated from the house, (equivalent of insulated/back door between) does not need a BC certificate.... Read More

Definetly one to avoid. I suspect they are losing properties and trying to tie up what they have.
Even evicting the tenant wont get rid of them, clause 2 says they can start again!... Read More

Council multiple flat HMO status for Fire Regs over-reaching?

There are several definitions for an HMO. We have buildings which have self contained flats, and they are technically HMO's even though there are no shared facilities. This is from the Housing Act 2004
Meaning of “house in multiple occupation”
(1)For the purposes of this Act a building or a part of a building is a “house in multiple occupation” if—
(a)it meets the conditions in subsection (2) (“the standard test”);
(b)it meets the conditions in subsection (3) (“the self-contained flat test”);
(c)it meets the conditions in subsection (4) (“the converted building test”);
(d)an HMO declaration is in force in respect of it under section 255; or
(e)it is a converted block of flats to which section 257 applies.... Read More

Failed EPC Due to assumed no insulation?

If you have any electrical sockets on the walls, and it is dri-lined, there will be the plastic electric back boxes. Turn off the ring main and remove the face plate and you can usually remove the back box and you can see whats behind.

Put in a loft hatch, or at the very least an inspection hatch that you can get your head through. They can be fitted between the joists and glued onto the ceiling. Inspection hatch will cost £10-15 and will be there for when/if you need to get another EPC done, or check for any roof issues.... Read More

HMO COUNCIL TAX being changed on each room!

We have experienced this several times and given up the fight. Tenants now pay council tax, but everything else included. We once had an even bigger scare from Building Control. We put in plans for a conversion creating a house with 10 bed-sitting rooms, with en-suite and kitchenettes. Conversion was all complete then with the final BC inspection, with some tenants already moved in, the new officer declared they were all flats, and needed the full independent sound testing, energy performance checks and additional fire protection, as applied to new builds.
This ended in a court case, with barristers employed by both sides, and we ended with a draw. The case was dismissed as they had not acted within the permitted time scale.... Read More
